1. Who we are
Visiaq is operated by Flowin, SIA, registration number 40203053267, registered at Miera iela 97 - 26, Rīga, LV-1013, Latvia (“Visiaq”, “we”, “us”). You can reach us at hello@visiaq.io.
These Terms govern your use of the website at visiaq.com, the free AI visibility audit, and the Visiaq application, including any paid plans (together, the “Service”). By using the Service you agree to these Terms. If you use the Service on behalf of a company, you confirm that you are authorised to bind that company, and “you” means the company.
2. What the Service does
Visiaq reads publicly available pages of a website you specify and reports how well AI assistants such as ChatGPT, Claude and Gemini can access, understand and describe the company behind it. The free audit is based only on what the website itself publishes. Paid features may additionally send questions to third-party AI models and report what they answer.
The Service is a diagnostic tool. Scores, findings and suggested fixes are our assessment at the time of the audit. They are not a guarantee that any AI assistant will mention, describe or recommend your company, and AI assistants change their behaviour without notice. You remain responsible for any changes you make to your website.
3. Using the Service
You may only audit websites that you own, operate, or are authorised to audit on behalf of their owner. You agree not to:
- use the Service to harass, profile or gather intelligence on third parties without a legitimate business reason;
- attempt to access accounts, data or systems that are not yours, or interfere with the Service’s operation;
- run automated or bulk requests against the Service except through features we provide for that purpose;
- resell or redistribute the Service or its reports without our written agreement;
- use the Service in breach of applicable law or of the terms of the AI providers whose answers it reports.
We may limit, suspend or end access that breaches these Terms or puts the Service or other users at risk.
4. Accounts
Some features require an account. You must give accurate information, keep your credentials confidential and tell us promptly if you believe your account has been compromised. You are responsible for activity under your account. You can close your account at any time from the application or by emailing us.
5. Free and paid plans
The audit is free and does not require an account. Paid plans, including the Pro tier, are offered as described on the pricing page at the time you subscribe. Prices are stated exclusive of VAT unless we say otherwise. Subscriptions renew automatically for the same period until cancelled; you can cancel at any time and keep access until the end of the paid period. Where a feature is described as in development or coming soon, it is not part of any plan until it is released.
If you are a consumer in the EU you may have a statutory right of withdrawal within 14 days of purchase. By asking us to start a paid service immediately you acknowledge that this right is lost once the service has been fully performed.
6. Your content and our reports
You keep all rights to your website and to any content you provide. You grant us the permission needed to fetch, store and analyse the pages you ask us to audit and to show you the results. Reports we generate for you are yours to use for your business. The Service itself, including its software, design, scoring method and brand, remains ours.
Suggested fixes such as schema markup or text files are generated for you to review. Check them before publishing them on your website.
7. Third-party services
The Service relies on third-party providers, including hosting, database and email providers and, for paid features, AI model providers. Their availability and behaviour are outside our control. Where the Service reports what an AI assistant said, that content is the assistant’s output, not our statement of fact.
8. Availability and changes
We aim to keep the Service available but do not promise uninterrupted or error-free operation. We may change, add or remove features. If a change materially reduces what a paid plan provides, we will tell you in advance and you may cancel with a pro-rata refund of any prepaid, unused period.
9. Liability
To the extent permitted by law, the Service is provided as is, and we are not liable for indirect or consequential loss, lost profit, lost revenue or lost data arising from your use of the Service. Our total liability to you for any claim arising out of the Service in any twelve-month period is limited to the amount you paid us for the Service in that period, or EUR 100 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, including for wilful misconduct or gross negligence.
10. Privacy
How we handle personal data is described in our Privacy Policy, which forms part of these Terms.
11. Changes to these Terms
We may update these Terms. The date at the top shows the current version. For material changes we will notify account holders by email or in the application at least 14 days before they take effect. Continued use after that date means you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Latvia. Disputes are subject to the courts of Latvia, without prejudice to any rights you have as a consumer under the mandatory law of your country of residence. EU consumers may also use the European Commission’s online dispute resolution platform.
